Proposed Amended "Means Test" Forms

Effective on January 1, 2008

At its September 2007 meeting, the Judicial Conference deferred action on proposed amendments to Official Forms 22A, 22B, and 22C after the Internal Revenue Service revised its Collection Financial Standards. Because the "means test" forms are based on the national standards and local standards set out in the IRS document, conforming changes to Forms 22A and 22C became necessary. In order to reduce possible confusion, the Judicial Conference also deferred action on the proposed revisions to Form 22B.

The Advisory Committee on Bankruptcy Rules has proposed revisions to Forms 22A and 22C which reflect the changes in the IRS standards. The Advisory Committee has recommended that the changes be effective on January 1, 2008, when the IRS changes will be effective in bankruptcy cases. The proposed amendments have been approved by the Committee on Rules of Practice and Procedure. Although the changes have not yet been approved by the Judicial Conference, copies of the proposed amendments are posted here in order to give the courts, attorneys, software companies, forms publishers, and the public as much time as possible to implement the proposed revisions before the recommended effective date of January 1. Amended Bankruptcy Official Forms

Effective on December 1, 2007

At its September 2007 meeting, the Judicial Conference approved proposed amendments to Bankruptcy Official Forms 1, 3A, 3B, 4, 5, 6, 7, 9, 10, 16A, 18, 19, 21, 23, and 24, and new Official Forms 25A, 25B, 25C, and 26. The amendments to the existing Official Forms will be effective on December 1, 2007. New Official Forms 25A, 25B, 25C, and 26 will effective December 1, 2008, to coincide with rule amendments taking effect on same day.

Copies of amended forms and Committee Notes setting out changes in the forms have been provided in order to give the courts, attorneys, software vendors, publishers, and the public time to prepare for using the amended forms.

Amended Director's Forms

Effective August 1, 2007

The Director of the Administrative Office of the United States Courts has issued amendments to the following Bankruptcy Director's Procedural Forms. The amendments, which will be effective on August 1, 2007, will conform these forms to the pending amendment to Official Form 16A and new Rule 9037, which will be effective on December 1, 2007. Additional amendments are stylistic.
